The town of Banff’s Smoke-Free Bylaw goes into effect tomorrow.
The bylaw prevents smoking, vaping and the use of tobacco products at most public places in the town of Banff which is located in Banff National Park.
The Bylaw which was passed in December of 2022, prohibits the public from smoking or vaping at:
- Bus stops
- Public sidewalks and pedestrian zones
- Municipal parks/parkettes/green spaces
- Trails and Pathways
- Outdoor markets
- Outdoor events
- in proximity to children not in one’s custody, care or control.
The new bylaw in combination with existing Alberta laws means that the only places the public can smoke will be on outdoor parking areas, alleys and private property. Smoking must be kept at least 5 meters away from sidewalks or trails.
The use of tobacco in Indigenous ceremonies is allowed.
The Town says businesses can designate areas for smoking on their private property, like hotel grounds and sidewalks leading to restaurants, off the public sidewalks, but not in public spaces like parks or sidewalks.
Non-compliance will lead to a $250 fine. The town website states, “Municipal Enforcement officers will take an education-first approach, like any new bylaw, as the goal is for compliance.”
