Federally regulated employers in Canada are now required to provide free menstrual products in the workplace, announced Minister of Labour Seamus O’Regan Jr. today.
Pads and tampons must now be available in an accessible and private location, like a washroom or office supply cabinet, benefiting nearly half a million employees.
The provision of menstrual products is aimed at creating healthier and more inclusive workplaces, improving gender equity, and reducing period stigma. Employers are already providing basic sanitation items like toilet paper and soap, and this new requirement extends to menstrual products in all toilet rooms controlled by the employer. These products must be available in each toilet stall, with disposal containers provided accordingly.
Employment and Social Development Canada says employers are responsible for choosing the menstrual products, taking into consideration employee feedback, body sizes, menstrual flow, cultural values, and environmental considerations. While reusable products can also be offered, they cannot replace the mandatory provision of tampons and pads.
Menstrual products should be stocked and dispensed to ensure cleanliness and hygiene, considering the toilet room environment and the number of employees. Alternate locations within the workplace may be used if they offer privacy and easy access.
This regulation does not extend to workplaces not controlled by the employer, like home offices or third-party premises. However, employers are encouraged to consider providing menstrual products in these scenarios, like offering kits for employees in mobile workplaces. Additionally, providing health and hygiene information related to menstrual products is recommended.
